What this covers
These terms cover your use of our website and customer account. A separate contingency fee agreement, which you sign before we do any billed work, covers the audit and claim-filing service itself and controls if the two ever conflict.
The service
We read a utility bill you provide, compare it against the utility's filed rate schedule, and, where you authorize us in writing, file a claim with the utility to recover an overcharge we find.
We do not guarantee that any audit will find a recoverable error, or that any claim we file will be paid. Many audits find nothing to recover.
Fees
Our fee is a percentage of money your utility actually credits or refunds because of a claim we filed, as stated on our pricing page and in your fee agreement. We do not charge for an audit that finds nothing, for a finding your utility declines, or for anything before money reaches you.
Your account
You're responsible for the accuracy of the information you give us and for keeping your account credentials to yourself. You can invite teammates to your account; you're responsible for what they do with that access.
Authorization
Before we contact a utility on your behalf, you sign a letter of authorization naming us and the specific utility account it covers. That authorization does not let us switch your service, open or close an account, or agree to anything beyond discussing the billing question it names. You can revoke it in writing at any time; work already filed continues to its conclusion.
Limitation of liability
To the extent the law allows, our liability to you for anything arising from this service is limited to the fees you've actually paid us in the twelve months before the claim arose. We are not liable for indirect or consequential losses.
Governing law
These terms are governed by the laws of the State of [STATE], without regard to conflict-of-law rules.
Changes
We may update these terms from time to time. We'll post the current version here with the date it took effect.
